$100K Settlement: Drunk Driver Causes Collision in Virginia
A $100,000 settlement has been reached in a case involving a driver injured in a collision caused by a drunk driver running a red light in Virginia. The incident occurred just after midnight when the plaintiff, driving through an intersection on a green light, was hit by a vehicle speeding at 50 mph in a 25-mph zone. The force of the impact caused the plaintiff’s car to spin into a METRO bus and then into a pole. The collision was captured by cameras on the bus.
The defendant, who was later arrested for driving while intoxicated (DWI) and resisting arrest, fled the country after the incident. The plaintiff, who suffered a concussion, neck and back pain, rib and shoulder pain, and multiple contusions, received chiropractic care, manual therapy, and neurology consultations, with medical expenses totaling $12,225. The plaintiff also experienced headaches, memory issues, and sleep disturbances as a result of the crash.
Liability was resolved after the defendant’s financial circumstances made pursuing an excess judgment impossible. The case settled for the available insurance limits of $100,000, with $50,000 paid by GEICO, and an additional $50,000 under the plaintiff’s underinsured motorist (UIM) coverage through Travelers.
