$1.25M Settlement: Pedestrian Struck by Vehicle in Parking Lot
A Connecticut woman, Deborah Okolovitch, has received a $1.25 million settlement after suffering severe injuries when she was struck by a vehicle while crossing the street. The incident occurred as Mark Lofthouse exited a parking lot and allegedly hit Okolovitch, causing significant injuries.
Okolovitch sustained fractures to three ribs, her hip, and her sacrum. Her injuries required hip surgery, and a wound on her hip needed draining, with further surgery anticipated to close the wound. As a result, Okolovitch was unable to work from March and is not expected to return to work until October. Her medical expenses have already reached $250,000.
Liability in the case was complicated by the fact that Okolovitch was not in a designated crosswalk at the time of the accident, and she was cited by police for this. However, the absence of a nearby crosswalk and the regular presence of pedestrians parking on the side of the road were significant factors in the case. The legal team argued that Lofthouse should have been more vigilant, knowing the area frequently sees foot traffic.
Initially, Allstate, the driver’s insurance provider, offered $600,000 to settle the claim. However, after negotiations and with the possibility of a lawsuit being filed, Allstate ultimately agreed to tender the policy limit of $1.25 million.
