$7M Settlement: Deputy’s High-Speed Crash Claims Toddler’s Life
The Luna County Commission has approved a $7 million settlement stemming from a tragic crash involving a deputy responding to an emergency call. The collision occurred on November 11, 2023, at the intersection of NM-11 and Voorhies Road, when Deputy Paul Garcia, 31, was driving an LCSO patrol vehicle at approximately 130 mph.
Garcia’s patrol car struck another vehicle, killing a 14-month-old toddler and seriously injuring the driver, Isabella Hernandez. The deputy had been responding to a burglary call at the time of the crash. The toddler’s death and Hernandez’s severe injuries prompted a lawsuit that resulted in the multi-million-dollar settlement.
Following the incident, Garcia was terminated from the Luna County Sheriff’s Office and now faces felony charges. His trial is set to begin in August.
The settlement brings some resolution to a devastating event that has profoundly impacted the victims’ families and the community. It also underscores the consequences of reckless behavior, even during emergency response situations.
